Information about personal data handling

We, Amasus Investment Ltd. (hereafter Amasus), are an independent, owner-managed Swiss asset manager based in Zurich. We operate the website www.amasus.ch and the services offered on it and are therefore responsible for the collection, processing and use of your personal information on this website.

Your trust is very important to us and we want you to be able to visit our website without any worries. That is why we take all appropiate measures to comply with data protection laws and also your data security. We comply with the statutory provisions of the Federal Data Protection Act (DSG), the Ordinance to the Federal Law on Data Protection (VDSG), the Telecommunications Act (FMG) as well as other data protection regulations, for example the Basic Data Protection Regulation of the European Union (hereinafter DSGVO).

Therefore, we would like to inform you about the handling of your personal data. Please note that this privacy policy can be updated at any time. Thus, we recommend that you consult them regularly.

Basic information on data processing and legal bases

Our Privacy Policy explains how we process your personal information and determine what information we collect or obtain and how we use and protect your personal information in accordance with applicable law.

This Privacy Policy explains the nature, scope and purpose of the processing of personal information in connection with the functionality of our website and the services offered thereon. The privacy policy applies regardless of the domains, systems, platforms, and devices (such as desktop or mobile) used to run the online offering.

  • Inventory data (e.g. names and addresses of customers),
  • Contract data (e.g. services used, names of companies and persons),
  • usage data (e.g. the visited websites of our online offer, interest in our services) and
  • Content data (e.g. entries in the contact form or comments).

The term “user” covers all categories of persons affected by data processing. These include our business partners, customers, prospects and other visitors to our websites and their online offers.

We process your personal data only in compliance with the relevant data protection regulations. This means that your data will only be processed if there is a legal permit, in particular if the data processing is needed resp. required by law to provide our online services and our contractual services (e.g. processing of orders), or if consent is given, as well as due to our legitimate interests (i.e. interest in the analysis, optimization and economic operation and safety our online offer, in particular in the range measurement, creation of profiles
for advertising and marketing purposes and collection of access data and use of third-party services).

Safety measures

We use technical and organizational security measures in accordance with recognized market standards to protect personal data stored with us against unintentional, unlawful or unauthorized manipulation, deletion, alteration, access, disclosure or use and against partial or complete loss.

Our website www.amasus.ch is operated on servers of the hosting provider Cyon, which are located in certified and secured data centers in Basel (Switzerland). The connection to the servers is made using SSL encryption, which can be recognized by the URL that begins with “https”.

Of great importance is the corporate privacy. That’s why all of our employees and the service companies commissioned by us are committed to secrecy and compliance with data protection regulations.

Disclosure of data to third parties and third-party providers

Your personal data will only be disclosed if you have expressly consented, if there is a legal obligation to do so or if this is required to enforce our rights, in particular for the enforcement of claims arising from a contractual relationship.

In addition, we pass on your data to external service providers, as far as this is necessary for the execution of the agreement. These service providers use your data exclusively for order processing and not for further purposes.

We will never sell your personal information to third parties.

In the context of this Privacy Policy, if content, tools or other instruments of external providers (collectively referred to as “third-party providers”) are used and whose registered office is located in a third country (not in Switzerland), is to be assumed, that a data transfer takes place to the states of residence of the thirdparty providers. The transfer of data to third countries occurs either when there is an adequate level of data protection, if the user consented to or with legal authorization.

For certain services, we work with specialized companies (for example, to operate our e-mail newsletter). For this purpose, personal data is transferred on our part in order to be able to operate this service. Here we take appropriate legal precautions and appropriate technical and organizational measures, to ensure the protection of personal data in accordance with the relevant legal regulations.

Communication & CRM

When contacting us (via contact form or e-mail) the details of the user are needed to handle the contact request and its processing. User information can be stored in our Customer Relationship Management System (“CRM System”).

We use the CRM system “Consolidate”, a software of Consolidate Software LLC, Austria, for the efficient and fast processing of user requests. For this purpose, we have concluded a contract with Consolidate with so-called standard contractual clauses, where Consolidate commits to processing user data only in accordance with our instructions and to comply with Swiss and EU data protection standards. Newsletter

With the following information we explain you the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures as well as your right of objection. By subscribing to our newsletter, you agree to the receipt and the procedures described and agree that we may use your personal information for promotional activities, such as to send e-mails with promotional character (newsletter).

If you prefer not to receive marketing communications or newsletters from us, you can unsubscribe by following the unsubscribe instructions at the end of each e-mail or contacting us.

 

Newsletter content

We send newsletters, e-mails and other electronic notifications with advertising information (hereinafter “newsletter”) only with the consent of the recipient or a legal permission. As part of the registration for the newsletter, the expected content is described concretely and they are relevant for the consent of the users. Furthermore, our newsletters contain information about our offers, events and promotions, our company and the latest news from the financial industry.

 

Use of the e-mail marketing provider „Campaign Monitor“

The dispatch of the newsletter takes place by means of „Campaign Monitor“, a newsletter dispatch
platform of the Australian provider Campaign Monitor, Level 38, 201 Elizabeth Street, Sydney NSW 2000, Australia (www.campaignmonitor.com).

The e-mail addresses of our newsletter recipients as well as their other data described in these notes, are stored on the servers of Campaign Monitor in Australia, USA and Germany. Campaign Monitor uses this information to send and evaluate the newsletter on our behalf. In addition, Campaign Monitor may, according to its own information, use this data to optimize or improve its own services, for example, to optimize the technical delivery and the presentation of the newsletter or for economic purposes, to determine from which countries the recipients come. Campaign Monitor does not use the data of our newsletter recipients to write them down or to pass them on to third parties.

We rely on the reliability, the IT and data security of Campaign Monitor. Campaign Monitor works on safety according to ISO 27001 standards and declares to complain with the EU data protection requirements under the GDPR on 25 May 2018. Login details

To subscribe to the newsletter, it is sufficient to enter your e-mail address. Optionally, we ask you to provide your first and last name as well as your salutation. This information is only used for the personalization of the newsletter.

 

Statistical survey and analysis

The newsletters contain a so-called „web-beacon“, i.e. a pixel-size file that is retrieved from the Campaign Monitor server when the newsletter is opened. As part of this call, technical information such as information about the browser and your system, as well as your IP address and time of retrieval will be collected. This information is used to improve the technical performance of services based on their specifications or the audience and their reading habits, based on their locations (which can be determined using the IP address) or access times.

The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients, but it is neither our intention nor that of Campaign Monitor to observe individual users. Rather, the evaluations serve to better arrange the information and offers in our newsletter with the individual interests of the respective recipient.The web-beacon will be deleted when you delete the newsletter.

To stop the use of the web-beacon in our newsletter, please set your mail program so that no HTML is displayed in messages (if this is not already the case by default). On the following pages you will find explanations on how to make this setting for the most common e-mail programs:

 

Online request and data management

There are cases where we direct the newsletter recipients to the Campaign Monitor websites. For example, our newsletters contain a link that allows the newsletter recipients to retrieve the newsletters online (for example, in the case of display problems in the e-mail program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Similarly, Campaign Monitor’s Privacy Policy is only available on its page.
In this context, we point out that cookies are used on the websites of Campaign Monitor and so personal data is processed by Campaign Monitor, its partners and service providers (e.g. Google Analytics). In addition, we point out to you the possibility of objection to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European area).

 

Termination / cancellation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. A link to cancel the newsletter can be found at the end of each newsletter. After termination your data will be deleted except for the e-mail address. The e-mail address will be stored in a blacklist and will only be used to ensure that we do not send any further e-mails to your e-mail address.

Right to information, erasure and rectification

You have the right to be informed as to whether we process personal data about you. You can always request information about your personal data stored by us. A formal request for information must be made in writing and under proof of identity.

We store personal information you submit to us as long as we deem it useful to contact you regarding the newsletter service or our other service, or to fulfill our legal obligations, settle disputes and enforce our contracts. Then we delete the data in a secure way. You can also delete or correct your data at any time. This can be done by sending a request by e-mail to info@amasus.ch. We point out that in case of deletion of your data a claim of our services is not (or not fully) possible.

Consents to certain data processing can be revoked at any time with effect for the future.

Please note that all data that has to be stored for a longer period of time is excluded from deletion or anonymization in order to fulfill the retention requirements (legal archiving, obligation according to bank supervisory authorities).
